INTELLECTUAL PROPERTY - BASIC DEFINITIONS

Industrial Design:

A composition of lines and/or colors, or a three-dimensional form or any material, whether or not associated with lines or colors, provided that such composition, form or material gives special appearance to a product of industry or handicraft and appeals to and is judged by the eye.

Trademark:

Trade Mark is defined as a mark used or proposed to be used in relation to goods for the purpose of indication, or as to indicate a connection between the goods and a person who has the right either as proprietor or registered user to use the mark whether with or without an indication of the identity of that person.

Copyright and Related Rights:

Copyright is a legal term for a limited monopoly for aspects of moral and property rights. It is extended to expressions of ideas and not ideas, processes, methods of operation, systems, principles, discovery, mere data or concepts.

Geographical Indication:

A geographical indication is a sign used on goods that have a specific geographical origin that posses qualities or a reputation that are due to the place of origin.

Trade Secrets / Undisclosed Information:

Is protected information which is not generally known among, or readily accessible to persons that normally deal with the kind of information in question, has commercial value because it is secret, and has been subject to reasonable steps to keep it secret by the person lawfully in control of the information.

Intellectual Property

Intellectual Property refers to creations of the mind: inventions, literary and artistic works, and symbols, names, and images used in commerce. Intellectual Property is divided into two broad categories:

(i) Industrial property includes patents for inventions, industrial designs and geographical indications.

(ii) Copyright includes literary, musical and artistic works and architectural designs. Rights related to copyright include those of performing artists in their performances, producers of phonograms, and those of broadcasters in their radio and television programs.

Patent

A Patent is an exclusive right granted to an invention, which is product or a process that provides a new way of doing something, or offers a new technical solution to a problem. A patent provides protection for the invention to the owner of the patent for a limited period, generally 20 years
