Minimum filing requirements for Trademarks :
Minimum requirement for filing only applies to the trade mark matters involving filing of an application form. This does not apply to Trade Mark Searches and other general client queries.
The minimum filing requirements for filing of all trade mark related applications should include the basic following requirements:
- Clear (written) indication of the applicant's request or intention
- The prescribed application form that is complete. Application forms can be either downloaded or collected at our office .
- Prescribed application fees
- Clear legible representation of the proposed trade mark
Other additional requirements:
Where the request includes a change (amendment/alteration) to the owner's (proprietor) name, a certificate of change of name/incorporation (either original or certified) is required.
Registered User
Where the request includes a request to record a registered user or licensee, a registered user agreement or license agreement (either original or certified) should be furnished.
Deed of assignment / transmission
Where the request includes a request to record an assignment/transmission, a Deed of Assignment/transmission document (either original or certified) should be furnished.
Trademark Application Guide
The Trademark Application Guide must be obtained and consulted . The instruction guide will provide the guidelines to correctly complete the form.
