Do I have to specify the Goods and Services to which my trade mark is applied? You will have to specify the goods or services to which your trade mark is applied, or to be applied in the future. An application must be limited to the goods or services in one class only. You will also have to specify the class in which your goods or services fall, for example, most clothing and footwear falls in class 25. Generally speaking, you should not specify "all goods in this class" unless you can justify such a wide ambit. This is particularly true in the case of classes 6, 7, 12, 20, 21 and 31. I need more information on Classification of Goods and Services! How much does it cost to register a Trademark? The cost of registration of the trade mark is K350. Additional fee of K50 shall apply if your trade mark is associated. Specific charges relating to association of trade marks, amendment etc. These are listed in Schedule 4 of the Trade Marks (Amendment) Regulation 1994. How long will it take to Register a Trade Mark? An application must be examined by the IPOPNG before it can be accepted. If the application has been prepared carefully, for example, if good quality representations have been supplied and there is what appears to be a reasonable specification of goods or services then there should be no objection from this office, except perhaps to call for an association of marks. What happens if there are similiar or same trade marks already regsitered? However, it may be that the same mark, or a similar is already on the Registrar for the same goods or services of the same description, for example, goods which have a similar nature or composition, have similar uses and are normally bought or sold together. This Office will set time limits of 6 (or 9 months where evidence of use is required) for overcoming of objections. Publication in the Journal! After acceptance, a new application is advertised in Trade Marks Journal for opposition. For example, a person may feel that he has a better claim to ownership of the mark than the applicant. The applicant may resist this opposition. How long is the period of opposition? The period for lodging opposition lasts for three months only, unless it is extended specially on request of the opponent. If no opposition is lodged, the application may proceed to registration, provided the registration fee is paid within 6 months. Opposition may delay, or even prevent, registration. Records can be searched between 9:00 a.m. to 12:00 noon and 1:00p.m. to 4:00 p.m every working day.
